TCEQ challenge docketed as August 10 county-authority vote approaches

TCEQ indexes two amended motions asking the Commission to review and stay Pacifico's TXR1565YW and Black Chamber's TXR1551YV; neither authorization has been stayed, and the filings' assertions are not agency findings. Editor's note, August 11: Commissioners Court tabled Item E.4 after strong community input. TCEQ now indexes two amended motions under Pacifico's construction-stormwater authorization. They ask the Commission to review and stay both Pacifico's TXR1565YW and Black Chamber's TXR1551YV. Filing those motions did not itself suspend either authorization, and TCEQ has not adopted the filers' allegations as agency findings.

What the new docket establishes—and what it does not

Commissioners' Action Item 147527, Docket 2026-0805-WQ, is indexed under Pacifico's authorization. TCEQ's activity record shows two Motions to Overturn received July 20. The amended filings ask TCEQ to review and stay both operators' authorizations together and raise drainage, boundary and runoff concerns.

Those concerns are allegations by the filers, not agency determinations. Both authorizations remain listed as active, no stay or Commission order is posted, and the matter does not appear on TCEQ's August 12 final agenda. Under 30 TAC §50.139(d), an Executive Director action remains effective unless the Commission expressly orders otherwise.

County policy

The signed tax-abatement record is now public

Bastrop County's signed 16-page record confirms that Commissioners Court adopted the Chapter 312 policy July 27 for a two-year term. It marks Commissioner Mark Meuth absent. The policy generally requires $20 million of added value and 25 sustained full-time jobs for a new business, and it includes local hiring, contracting, environmental-disclosure, compliance and recapture provisions.

It also permits up to 100% abatement for as long as ten years when the Court finds “extraordinary economic benefit,” without defining that phrase. A change to grade or drainage counts as commencement of construction for eligibility purposes. The record does not establish that such work has begun at Cedar Creek.

Adoption made the County eligible to consider abatements. It did not approve either Pacifico-specific application, reinvestment zone or agreement.

Item E.4 was tabled after strong community input

This article originally advised residents to support Item E.4 while pressing the County to use existing incentive powers. That guidance was wrong. Nick Lealos and LIV identified a deeper defect: the draft itself could have understated authority the County may already possess. Residents were right to urge tabling rather than adoption as written.

  • Do not bring Item E.4 back unchanged.
  • Publish legal analysis of existing fire-safety, BESS, health, infrastructure, records, and incentive tools.
  • Require full-buildout disclosure, independent review, and enforceable protections before any Pacifico abatement.
  • Continue seeking stronger state authority without conceding away present tools.

At the time of this August 9 sweep, no publicly identifiable Pacifico Cedar Creek air-permit entry appeared on TCEQ's pending NSR list; JETI J0049 remained in Application Phase; and no confirmed Aqua return date, ERCOT queue status, turbine order, contractor award, financing commitment or disclosed hyperscaler had surfaced. Absence from a public status page does not prove that private pre-application work is not underway.
