Senator Schwertner’s September 1 letter asked TCEQ for a response by September 18. Ask his office to publish it. Ask Representative Gerdes to obtain written confirmation of the review stage and progress on a public meeting.

LPW’s September 3 update documents both offices’ involvement. Keep asking for the corrected application, deficiency correspondence and a written explanation of which permitting requirements apply to the entire project.

Bluebonnet's official 2026 schedule lists September 15. The cooperative says to check back the Friday before the meeting for an agenda; no Pacifico item is currently confirmed.

What to ask: Before attending, verify the time, venue, access rules and whether public questions will be accepted. Watch for any Pacifico, Black Chamber, large-load, interconnection, substation or infrastructure item.

LPGCD has posted September 16 notices for proposed Desired Future Conditions (DFCs) and Aqua municipal well LP-996474. Both notices list 3:30 p.m.; confirm the order with the district. The regular board meeting follows the DFC hearing. Neither notice identifies a Pacifico permit decision.

What to ask: Comment on long-term aquifer drawdown, cumulative demand and protections for existing wells. Written DFC comments can be sent to lpgcd@lostpineswater.org before or at the hearing. Do not describe the Aqua well as a Pacifico supply well without supporting records.

Aqua’s September 1 Pacifico item passed and moved into Non-Standard Service Agreement (NSSA) negotiations. Ask for the negotiated agreement and enforceable water limits before final action.   • Environmental disclosure is undefined and qualified by “to the extent practical and applicable”; no required methods, baselines, modeling, or independent certification.
  • No full-buildout or cumulative-impact rule covering affiliates, co-located generation, data centers, backup generators, pipelines, substations, or shared water demand.
  • No required online publication date, minimum public-review period, or mandatory hearing before the final abatement agreement.
  • A majority may grant variances, while the “extraordinary economic benefit” needed for a 100% abatement is not defined.
  • The 25-job threshold matches Pacifico’s earlier JETI projection; there is no benefits-per-job test. The August air application describes 48 turbines totaling 1,326 MW maximum nominal output, a different scope and rating basis from the earlier 710 MW JETI figure.
  • No alternative-site analysis, residential or school buffer, drought test, emergency-capacity standard, or binding denial criterion for an incompatible site.

Pause discretionary abatements

Do not approve new data-center or co-located generation abatements until sector-specific standards and cumulative-impact rules are adopted.

Require one full-buildout disclosure

Aggregate every phase, affiliate, host parcel, turbine, backup generator, data hall, substation, pipeline, water source, and reasonably foreseeable expansion.

Quantify community burdens

Require water and power demand, ratepayer effects, air emissions, noise, traffic, drainage, fire-water, hazardous materials, evacuation, and drought consequences.

Make independent review mandatory

Use applicant-funded experts selected by the county, publish their work, and require written resolution of material deficiencies before a hearing.

Guarantee public review

Post the full application and technical record online, allow at least 30 days for review, and require a hearing before every final agreement.

Require residential and school proximity, emergency capacity, water, road, wildfire, and alternative-site findings—and deny abatements where the site is incompatible.

  2. Your position: oppose the proposed industrial siting and ask officials to use every applicable development, emergency and transparency tool.
  3. Your evidence: the air application's stated 1,326 MW maximum nominal output, the earlier 710 MW JETI figure, the earlier JETI projection of 25 permanent jobs, nearby residential sites, and unresolved fire, water and cumulative-impact questions.
  4. Your ask: publish issued approvals and their conditions, strengthen future policy, request full agency review, and press Pacifico to seek a more suitable industrial location.
