Residents should file hearing and public-meeting requests now; press Gerdes, Schwertner, Cruz and Cornyn for renewed follow-through; and ask Governor Abbott to apply his August 23 rural-community standard in Cedar Creek. Aqua WSC separately placed a vote on Large Volume Water Service to Pacifico on its September 1 agenda; the new resolution and proposed agreement are not publicly available.

The official record shows the deficiency cycle ran August 21–26 and a “Final Package Rework Cycle” began August 26. The public status remains PENDING, with no completed final action posted.

Item 6 schedules a Pacifico water-service vote
The Board meets at 9:00 a.m. at 401 Old Austin Highway in Bastrop. Item 6 says the Board will “discuss and take action” on Large Volume Water Service to Pacifico through Resolution 26.09.01. The new resolution and proposed agreement are not publicly available.
Read the official agendaThe label indicates a late-stage internal work cycle and makes immediate action prudent. TCEQ does not define a guaranteed decision date on this public screen, and the registration is not approved. Describe it as pending and apparently near the end of staff review—not final.

Request a contested case hearing—and make TCEQ answer the process question.
This is an EGU standard-permit registration, not an ordinary case-by-case air-permit application. TCEQ may take the position that this route does not provide an individual contested-case-hearing right. The template below expressly requests a hearing, asks for a public meeting, and tells TCEQ to preserve the filing as an objection and explain every available remedy if it says a hearing is unavailable.
State your real address, approximate distance and direction from the facility, how you use your property, and specific health, safety, air, or property-use effects that would be different from the general public. Do not claim someone else's acreage, medical conditions, job, cattle, garden, hunting use, or neighboring activity. Formal filings can become public records, so omit unnecessary medical detail and children's names.

The public record still does not let residents verify all turbines, generators and phases; pollutant-by- pollutant potential to emit; source boundaries and aggregation; or the enforceability of proposed operating limits. TCEQ's records production also omitted the principal application attachment even though Pacifico's STEERS filing marked it “Confidential: No.”
Please take no final action until TCEQ releases the complete nonconfidential application and issues a written, whole-site potential-to-emit and standard-permit eligibility determination under 30 TAC §§116.12, 116.110 and 116.610. Please provide every public notice, comment, public-meeting and contested-case-hearing opportunity required by law.
If TCEQ contends that a contested case hearing is not legally available for this registration, please still treat this filing as a formal objection and request for inclusion in the project record. Before any final action, please identify the legal basis for denying the hearing request and explain every remaining administrative remedy and deadline. Please confirm receipt and association with Registration 185019 / Project 413471.
Put Registration 185019 / Project 413471 in the first line. Save the confirmation screen and your complete text. If eComments will not accept the registration, call the Chief Clerk at 512-239-3300 that day and ask how to file it formally. Do not assume a courtesy email alone preserves a legal deadline.
Do not assume TCEQ answered anyone
Ask five elected offices to press TCEQ again—and show residents the response.
For Representative Gerdes and Senator Schwertner, ask one direct question: “Has TCEQ answered your office in writing?” If the answer is no, ask them to contact TCEQ again that day. If the answer is yes, ask them to publish or summarize the response immediately. Cruz and Cornyn should also ask EPA Region 6 to examine the federal major-source, PSD and source-boundary questions. Governor Abbott should press his appointees and the agency publicly, while recognizing that he does not personally decide the registration.
In his August 23 ABC This Week interview, Abbott said data centers must not disturb “neighborhoods or rural communities” and that gaining support from people in local communities is “essential.” That protection is not evident here: TCEQ is nearing a decision while the principal nonconfidential application remains unavailable to the public and nearby residents are still asking to be heard. Ask the Governor to apply his stated standard here by publicly pressing TCEQ to pause, release the record and provide every available public-participation opportunity.
Pacifico Air Registration 185019 / Project 413471 is still pending, but TCEQ opened a “Final Package Rework Cycle” on August 26.
